GENERAL
TERMS AND CONDITIONS SUN AND SANDALS TOURS 1.
RESERVATIONS AND PAYMENTS 1.1
Reservations can be made by contacting The Reservations Department,
Sun and Sandals Tours Southern Africa and affiliate website partners, hereafter
referred to as the Company, through the central reservations centre in Johannesburg
South Africa. To reserve flights, accommodation and tours, weddings and events
we need full passenger names as they appear in Passports of passengers. 1.2.
All reservations will be issued with a confirmation invoice.
Please check this invoice carefully, spelling of names, scheduled tours, flight
details and times, wedding services and any other service you have booked with
Sun and Sandals Tours. The onus is on the client fully, to ensure these details
are correct as the confirmation invoice is utilised by service providers to book
the services. Deposit and final payment dates must be adhered to, to avoid
cancelation of the booking. 1.3.
Sun and Sandals Tours will not, under any circumstances, be
held responsible for services booked as per confirmation invoice which are not
correct once the client has received the confirmation invoice and signed the confirmation
invoice. 1.4
Tours and Travel as well as all Wedding Services are booked
and confirmed only on receipt of a 50% advance payment of the basic program rate
there are, however, some exceptions of suppliers and operators who require a NON
REFUNDABLE deposit of 50%.
This advance payment is due within 48 hours of confirming the arrangements. There
shall be no binding contract until the advance payment has been received by the
Company. Failure to remit your advance payment on time will result in an automatic
change of status of any confirmed space to a provisional basis and the possible
inability to reinstate your reservation. When the Company receives your advance
payment, a booking reference number will be assigned and noted on your original
invoice. The Company cannot be liable for any penalties or losses incurred as
a result of voluntary or involuntary changes to transportation schedules.
1.5
The balance is no later than 8 weeks prior to commencement
of the program. If the balance has not been received by that date, the Company
shall be entitled in its discretion to treat your reservation as canceled, and
consequently to forfeit such part of the advance payment as determined solely
by the Company. 1.6
The Company will not provide tickets, coupons, vouchers or
documents until full payment has been received. 1.7
The Company will not accept responsibility for wire transfer
and/or overnight mail charges. 1.8
Special airfares are capacity controlled and often sold out
months in advance. In addition, many accommodations offered by the Company have
limited capacity. It is essential to make reservations well in advance to ensure
your preferred arrangements. All quotes are therefore subject to change and availability.
All quotes are subject to exchange rate fluctuations up until the day of full
and final payment. 1.9
As part of our Privacy Policy Sun
and Sandals do not accept Credit Cards as a form of payment. Our preferred
method of payment is by electronic bank transfer.
1.10 DESTINATION WEDDINGS 1.10.1
Minimum lead time to process a wedding is 8 weeks. 1.10.2
Expedited weddings are at the sole discretion of the Country's Legal Officers
and the Property and Sun and Sandals tours will not be held responsible for weddings
which cannot be processed since Lead Time runs out due to non payment or omission
to send Documents or late booking. 1.10.3
it is the responsibility of the couple to ensure that wedding guests settle their
payments timeously. Sun and Sandals can invoice each wedding guest directly but
the final collection and ensuring guests' accounts are fully paid for prior to
the wedding rests entirely with the bridal couple. Sun and Sandals strongly suggest
couples discuss a destination wedding freely, honesty and openly with guests prior
to booking a venue to ascertain that the destination, flights, location and venue
is indeed, affordable for the group. Many packages including discounts rendered
by properties subject to a certain number of rooms booked on the wedding night
by the wedding party.
1.10.4
Discounts and promotions negotiated with venues and Sun and Sandals are offered
by the venue, hotel, resort, lodge or service provider. Such discounts, benefits,
promotions are given in the sole discretion of service providers and subject to
their Terms and Conditions. Should numbers of wedding guests change or minimize
in any way, Sun and Sandals Tours will not be responsible for discounts and free
nights being withdrawn by service providers. Such discounts and promotions are
entirely administered by the service provider and are in no way under the control
of Sun and Sandals Tours. 1.10.5
Booking of wedding services and venues are subject to availability and change
until full payment has been received. Venues affected by the weather may change
on the day according to the state of the weather and this is in no way the responsibility
of Sun and Sandals Tours. Sun and Sandals Tours is a wholesale tour operation,
not a wedding directory or wedding coordinator. We can only offer packaged weddings
as part of a tour service. Consultations will be charged for by either one of
our consultants or our wedding coordinator. 2.
CANCELLATIONS AND REFUNDS 2.1
Any cancellation of a booking must be in writing and shall only be effective upon
its acknowledged receipt by the Company. Cancellations
more than 8 weeks prior to departure once deposit has been received - your deposit
of 50% total package price is forfeited. If your cancellation is made
within 8 weeks of departure, cancellation charges will be levied. Less
than 8 weeks prior to departure - full payment forfeited
of total package price. 2.2
If you are a no show, the Company shall be entitled to treat your reservation
as canceled without having given the Company any notice, and the provisions of
Paragraph 2.1 shall apply. It is advisable to take out Travel Insurance for such
instances as well as lost luggage and delays. Please note that if the reason for
cancellation falls within the terms of any holiday insurance policy held by you,
such charges will normally be refunded by the insurance company, subject to the
terms of the insurance. 2.3
Any request to amend or change a booking once it has been confirmed may be accommodated
subject to space availability. Such changes, depending on how soon before departure
might be subject to a US$ 100 Levy to expedite the booking. These fees will be
added to your final invoice.
2.4 No refunds are given: (1) for lost travel time or substitution
of facilities, (2) for itineraries amended after departure, (3) for circumstances
arising beyond the Company's control, necessitating alternative arrangements being
made to ensure the safety and/or further participation and enjoyment of your program,
(4) if you do not appear for any accommodation, service, sightseeing or trip segment
without notifying the Company, or (5) if you leave your program after it has begun,
or miss any scheduled sightseeing, activities, meals or accommodations, wedding
or honeymoon services (6) if you suffer loss of services or inconvenience as a
result of traveling without the correct documentation, including passports, visas
and inoculation certificates, wedding documents. 2.5
For WEDDINGS - Cancellations and refunds for wedding services are determined as
per 2.1 - 2.4 above. The chosen ceremony and reception venue may also have Terms
and Conditions relating to deposits, cancellations and refunds. Upon invoice these
will be sent to clients for their due consideration and must be adhered to.
3.
RESPONSIBILITY CLAUSE 3.1
The information contained on this site is an invitation to do business and not
an offer. Sun and Sandals , act herein as agents for our respective business partners
and therefore any agreement resulting from the acceptance of an order is deemed
to be an agreement between the relevant business partner and yourself. The Company
acts as an agent only in producing and operating the tours and wedding coordination
of services 3.2
The Company acts as booking agent for hotels, airlines, air charters, bus companies,
ground transportation, boat purveyors or owners, wedding vendors and wedding services
and other independent contractors providing accommodations, transportation, and/or
other services abroad. Each of these companies is an independent corporation with
its own management and is not subject to the control of the Company, including,
but not limited to, various overseas ground operators. 3.3
All bookings like those described above are accepted by the Company, as agent
for independent overseas ground operators. The transportation, accommodations
and other services provided by the ground operators are offered subject to the
terms and conditions contained in the tickets, exchange orders or vouchers issued
by them and/or their suppliers. Wedding Venues are subject to Terms and Conditions
of each individual property. The Company acts only as an agent in producing this
site and operating these tour and wedding services on condition that the Company
shall not be liable for any loss, damage, injury, accident, delay or any other
irregularity that may be occasioned by defect, error or default of any company
or person engaged in these providing these services. 3.4
The Company reserves the right to cancel any itinerary or any part of it, to make
such alterations in the itinerary as it deems necessary or desirable, to refuse
to accept or to retain as a member of any program any person at any time, and
to pass on to program members any expenditure incurred by delays or events beyond
its control. In case of any appreciable variation in its cost, the Company reserves
the right to adjust its rates. Sun and Sandals makes every effort to ensure that
all arrangements and services connected with your package will be carried out
as specified in the most efficient and effective way possible. However we do not
have direct control of the provision of services by suppliers and whilst, every
supplier is chosen with the utmost care, we do not accept liability for errors
or omissions of such suppliers. 3.5
Sun and Sandals Tours is in no way responsible for the obtaining of Visas or
correct Passports and Travel Documentation necessary to enter a destination.
All Vaccination Certificates, Visas, Passports and travel documentation
is entirely the responsibility of the passenger as is the onus to contact
the necessary Embassy as to current requirements as well as Home Affairs for validity
of Passports. Sun and Sandals Tours is in no way responsible for wedding documentation
which should be in order prior to departure. Please ensure you have the necessary
documentation and copies thereof in order prior to departure. 3.6
Please also ensure that a rapport is created prior to a destination wedding with
your own Home Affairs in terms of a foreign civil wedding. The lodging of a civil
wedding certificate timeously with your own Home Affairs is entirely the responsibility
the client and Sun and Sandals Tours will not be held responsible for this. Nor
can Sun and Sandals Tour be held responsible for the delays, inefficiencies of
a Home Affairs Department. 4.
RISKS 4.1
The Company draws your attention to the fact that there are certain inherent risks
involved in participating in the type of trips sold by the Company.
4.2 It is your sole responsibility to take all appropriate
medical advice prior to departure as to whether or not you are fit enough to undertake
the trip booked. The Company shall not be liable for illness, injury or death
sustained on a program sold by the Company which is not due to the gross negligence
of the Company, its officers, employees, authorised representatives or agents
whomsoever.
5. FORCE MAIOR 5.1 Force Majeure means, in relation to the
Company, any circumstances beyond the reasonable control of the Company including,
but without limitation, acts of God, explosion, flood, tempest, fire or accident,
war or threat of war, sabotage, insurrection, civil disturbance, or requisition,
sickness, quarantine, government intervention, weather conditions or other unexpected
occurrences. For weddings - weather permitting some ceremonies and receptions
will be arranged outside. Should the weather not permit such a venue to be possible
an alternative venue shall be arranged and no refund given. 5.2
If the Company is affected by Force Majeure it shall forthwith notify you of the
nature and extent thereof. 5.3
The Company shall not be deemed to be in breach of these terms and conditions
or otherwise be liable to you, by reason of delay in performance, or by non-performance,
of any of its obligations hereunder to the extent that any such delay or non-performance
is due to any Force Majeure. 5.4
If the Company is affected by Force Majeure it shall be entitled to, and may in
its sole and absolute discretion, vary or cancel any itinerary or arrangement
in relation to the trip. Payment of any refund by the Company to you as a result
of the non-performance of any of the Company's obligations hereunder shall remain
in its sole and absolute discretion although the Company shall use its reasonable
endeavours to reimburse you where possible. However, the Company shall be entitled
to deduct from any refund recoverable the reasonable actual and potential costs
to the Company of the Force Majeure. 5.5
Regarding civil unrest, once the Company has investigated the prevailing situation
as it deems fit, it shall remain in the Company's sole and absolute discretion
whether to proceed with the trip. You may in such circumstances cancel the trip.
However, if, after having made all reasonable and proper inquiries, the Company
is of the opinion that the trip may proceed, no refund will be payable to you
and the provisions of Paragraph 2 shall apply. 5.6
With regards to weddings, 1.8 applies with regards to Force Majeure as well as
5.1 - 5.5. Should the wedding venues be unavailable on the day due to circumstances
beyond our control an alternative venue to the value of the package will be organised
any additional fees will be born by the client. 6.
INSURANCE
6.1 The Company strongly recommends that clients obtain the
following types of insurance which are commercially available: Accidental death
and disability, Emergency medical evacuation, Trip cancellation, Major Medical
and Loss of personal effects. 7.
SURCHARGES & EXCHANGE RATES 7.1
The company cannot be held liable when, through circumstances beyond our control,
a third party supplier imposes a price increase on their product/s after the client
has paid any monies toward such services. 8.
TERMS AND CONDITIONS These terms and conditions
govern the relationship between the Company and you, to the total exclusion of
any other terms and conditions. No alteration to the terms and conditions may
be made by any of the Company employees, authorised representatives or agents,
unless in writing by an authorised officer of the Company. All decisions and matters
subject to the Company's discretion shall be made by an authorised officer of
the Company. 9.
CARRIAGE BY LAND. SEA AND AIR 9.1
Carriage by Land, Sea and Air is subject to the terms and conditions of the carrier
with whom you travel and to international conventions, some of which may limit
liability. Land, Sea and Air travel are also subject to operational decisions
of carriers and air and sea ports which may result in cancellations, delays or
diversions, over which the Company has no control and for which the Company accepts
no liability whatsoever. 9.2
The passenger contract in use by the airline carriers concerned, when issued,
shall constitute the sole contract between the transportation companies and the
purchaser of these programs and/or the passengers.
9.3 CHARTER FLIGHTS 9.3.1 Charter flights booked with specific departure
times are strictly adhered to, and a no shows will be charged in full. Incoming
passengers coming off private or scheduled flights arriving 30 minutes or more
after scheduled arrival times will be treated as no shows and charged accordingly.
9.3.2 It is an expressed condition
that passengers' luggage is limited to 12kg. Only soft hold-all type bags will
be permitted. 10.
BAGGAGE Temporary or permanent loss of baggage is the responsibility of you
or the carrier.
10. DOCUMENTATION AND HEALTH REQUIREMENTS It
is the clients' responsibility to ensure that passports, visas, travel permits,
health certificates, inoculations, international driving license, legal requirements
for Civil weddings or other documentation required for the trip are obtained and
are in order.
The company may not be held liable for any failure on the part of a client to
be in possession of the correct travel or wedding documentation. Wedding documentation
requires minimum three months lead time to process. Sun and Sandals Tours will
not be liable for costs incurred sending legal documents abroad, costs levied
by a country to expedite a request, translation of such documents, obtaining the
valid Marriage Certificates and correcting Documents. Ensuring that the legal
requirements are met is the client's responsibility. Clients are advised to contact
the Department of Home Affairs timeously before a destination wedding.
11.
SPECIAL REQUESTS You must advise the Company in writing
of any special requests; e.g. diet, facility or physical handicap, when you submit
your reservation request to the Company. The Company will meet such requests,
if possible. 12.
INFORMATION IN THE TRAVEL PROPOSALS All information given
in the Company's travel proposals is, to the best of the Company's knowledge,
correct at the time of going to print but the Company reserves the right to change
same. The information provided in this travel proposals convey typical scenes
experienced and details on each destination; but the subject matter may not necessarily
be experienced in the exact detail thereof while visiting that destination. Quotations
are given subject to the exchange rate of the quoting day. Quotes may change after
24 hours subject to exchange rate fluctuations as well as departure tax increases
and other taxes, surcharges levied beyond our control. 13.
CONSENT The payment of the advance payment OR any
other partial payment for a reservation on a safari constitutes consent to all
provisions of the conditions and general information contained in the Company's
Internet Pages, Brochures, Invoice and Travel Documents. The terms under which
you agree to take these programs cannot be changed or amended except in writing
signed by an authorised officer of the Company. 14.
UNUSED SERVICES Any
deviation from the planned itinerary or the failure to use services , can unfortunately
not be refunded to passengers.
16. CONDITION OF BOOKING You
shall comply with the instructions of the Company's representatives at all times.
No Client shall be accepted or be permitted to continue on a program while their
status or mental or physical condition is, in the opinion of any representative
of the Company, such as to render them incapable of caring for themselves or make
themselves objectionable to other Clients or become a hazard to themselves or
other Clients and the Company will not be responsible for expenses by such persons
precluded from completing the program for this reason. 17.
NOTICE OF ENFORCEABILITY When you
book travel related services with the Company, you are entering into a binding
agreement that assumes all terms and conditions are fully understood as stated
here.
18. GENERAL INFORMATION 18.1
Insurance - Passengers are strongly advised to take out travel insurance covering
personal accident, medical expenses, baggage and loss of deposit or part of fares
lost through cancellations. 18.2 Driving Licence - If passengers intend to drive
a rental vehicle they should obtain the necessary driving permits to operate such
a vehicle. 18.3 Reconfirmation - Passengers are reminded that they are personally
responsible for reconfirmation of flights within 72 hours of arrival at any destination.
Failure to do so may result in the cancellation of a flight reservation by the
airline. 18.4 Purchases during travel - All services and tours booked through
Sun and Sandals must be pre paid for in full prior to departure. Whilst on holiday
any additional purchases, tours, services, upgrades, laundry, items of a personal
nature, accommodation, tips, gratuities shall be payable by the client in full
directly to such service provider. Sun and Sandals will, under no circumstances
be responsible for bill backs and accounts generated by clients during the duration
of the stay. 19.
YOUR PERSONAL RESPONSIBILITY The
onus is on all individual/s concerned to fully acquaint themselves with the Terms
and Conditions document and all matters such as visas, required documentation,
payment schedules and cancellation policies as well as services booked on the
confirmation invoice and the final payment deadlines. Sun and Sandals will assist
you to the best of our ability in providing answers and information pertaining
to your booking. Should you not find the information required on the site, the
onus is on the individual to forward any and all such requests to the Company,
which shall endeavor to the best of their ability to assist the traveler. 20.
CONTRACT The
contract entered into by a client and Sun and Sandals is applicable after the
payment of a deposit. The contract is entered into in the Republic of South Africa
and governed by the Law of the Republic of South Africa.
